Forum of Scottish Rugby Supporters ("FOSRS")
- Name, Objectives
- The name of the organisation shall be the Forum of Scottish Rugby Supporters (“FOSRS”)
- FOSRS shall be a body representing the views of supporters and customers of all levels of Scottish rugby. FOSRS shall seek to ensure that its opinions on the direction in which the Scottish Rugby Union (“SRU”) and the way in which the SRU conducts and manages itself are received and acted upon as appropriately by the relevant officers of the SRU.
- FOSRS shall serve the following principal purposes:
- To provide an opportunity for anyone interested in Scottish rugby to discuss the game and put forward their views and opinions;
- To try to ensure that the supporters’ voice is heard by the SRU and other relevant governmental and non-governmental bodies;
- To remind the SRU that it is dependent on the paying supporter for a significant amount of its income and should pay heed to supporters’ views and concerns;
- To increase government, media and public support for rugby; and
- To encourage and mobilise Scottish rugby supporters and well-wishers to support their clubs, professional sides and international teams.
- As a voice for supporters of Scottish rugby at club, professional and national level, the opinions of FOSRS will be formulated with the following principles in mind.
- A sound, viable and thriving Scottish club rugby scene;
- A competitive, well-funded and well-supported set of professional Scottish teams;
- A national XV that can realistically and consistently claim to be a contender for 6 Nations and World Cup honours;
- An SRU that is operated and managed by professionals in a professional way;
- An SRU that is transparent, communicative and responsive.
- FOSRS shall wherever possible maintain a website open to the public to comment on rugby matters.
- FOSRS shall be a non-legal entity.
- Membership of FOSRS
- Membership is open to all.
- There shall be two types of Member:
- Honorary Members: Those who register on the FOSRS website by introducing their names and details on registration shall be considered to be honorary members of FOSRS. At any point, such honorary members may request that their name and details be withdrawn in order to deregister their honorary membership. The Committee of FOSRS may set a fee for honorary membership.
- Committee Members: Those who are honorary members and have been elected to the Committee shall be Members of the Committee. Any honorary member may become a member of the Committee subject to election.
- The Committee Members may decide to establish a further class of membership with attendant rights and obligations as appropriate.
- Honorary Members
- Honorary members may, amongst other things:
- Post their views on the chatroom of FOSRS. Such views may influence the decisions taken by the Committee.
- Vote in a poll. If a minimum of 5% of honorary members cast a vote during the duration of the poll and over 2/3rds of the votes agree on one of the options presented by the poll, that option becomes a binding policy on the Committee unless 2/3rds of the Committee reject that option in a vote by way of a decision. If a minimum of 5% of honorary members cast a vote during the duration of the poll and over half of the votes agree on one of the options presented by the poll, that option shall not be a binding policy on the Committee and shall be at the Committee’s discretion.
- Submit their views to the FOSRS Committee by way of the contacts page on the website.
- Where time and other considerations permit, be given opportunities to comment on proposed FOSRS policies and initiatives.
- Stand for election to the Committee.
- Vote in the Committee election.
- Receive FOSRS newsletters, mailings and campaign information.
- Honorary members shall be bound by the principles in Annex I.
- Should an honorary member not abide by the principles in Annex I, his/her honorary membership may be cancelled by means of deregistration from the FOSRS website.
- Members of the Committee
- The Committee of FOSRS shall comprise the following:
- Office bearers: (a) a Chairman, (b) a Vice-Chairman; and (c) a Secretary and Treasurer.
- Up to 6 Ordinary Members or another number as subsequently decided by the Committee.
- The Committee members shall conduct themselves at all time in relation to FOSRS activities in accordance with the principles contained in Annex I.
- The Committee shall serve for a term of 2 years and may serve as many terms as elected. The Chairman may not serve for more than two consecutive years but after one year out of office may restand for the position. The election rules are contained in Annex II.
- Elections to the Committee shall be held during the calendar month of May every two years. In the event of any Committee officer resigning from office, which that member may do at the moment of his/her choosing by so indicating to the Chairman, the Chairman is empowered to appoint a replacement from the membership. The replacement will serve until the next election.
- In the event that the Chairman resigns, the Vice-Chairman shall automatically become Chairman.
- In the event that both the Chairman and Vice-Chairman resign, a Special Committee Meeting shall be called by the Secretary or failing that the Ordinary members of committee to elect a new Chairman and Vice-Chairman.
- Powers and Decision of the Committee
- The affairs, management, policies and actions of FOSRS shall be developed, conducted and directed by the Committee. Decisions regarding the affairs, management, policies and actions of FOSRS shall be taken by the Committee.
- The Committee shall represent and act in the interest of FOSRS, and its honorary members, the Scottish rugby supporter and customer.
- The Committee shall consider, amongst other things, the views of honorary members as:
- posted on the chatroom of the website of FOSRS;
- stated in the polls; and
- as otherwise indicated to it by those members
- The Committee shall not be under any obligation, except as stated under Article 3.1 above, to accept these as the views or as the policies of FOSRS unless it decides that to do so is in the interest of FOSRS.
- All decisions will be taken on a majority vote basis except as otherwise provided for in this Constitution. Each member of the Committee shall have one vote and in the event of a tied vote, the Chairman, or in his absence, the Vice-Chairman, shall have the casting vote. Decisions will normally be voted upon electronically. No proxies shall be allowed.
- In the event that an urgent decision must be taken and a full Committee vote cannot be held because of the absence of Committee members, for example, on holiday, the chairman and Vice-Chairman and one other office holder or member of the Committee may take the decision on the basis of unanimity between them. They shall explain the urgency to the other Committee members as soon after the decision has been taken.
- Once a decision is taken, that decision will be circulated to all members of the Committee.
- Any member of the Committee can submit a decision for vote at any time.
- The Committee is empowered to delegate any of its duties to one or more Operational teams which may comprise members of the Committee and any person or persons co-opted by the Operational team for the purpose of the Operational Team.
- The Committee shall have the powers to open and close bank accounts in order to manage the money and assets of FOSRS. The Committee shall have no powers to borrow any monies.
- The Committee shall have the powers to cease the operation of FOSRS.
- Members of the Committee and officers of the Committee shall report to the Committee as a whole.
- Amendments to the Constitution
- The Committee may amend the Constitution further to a 2/3rds vote in that regard.
- Termination of the Constitution
- The Constitution, and therefore FOSRS, shall be terminated upon a unanimous vote of the Committee. In the event of termination, any funds left shall be transferred by the Treasurer/Secretary to the David Azhar Appeal.
- Data Protection
- All personal data supplied by members of FOSRS shall be held by FOSRS and will not be disclosed to any other company or body other than the service provider and host of the website. The personal data will only be used for FOSRS purposes which will include informing members of forthcoming FOSRS events, polls, FOSRS-related updates and other FOSRS actions.
- Accounts
- The Secretary/Treasurer will maintain proper accounting records and present the annual balance sheet and Treasurer’s report to the Committee no later than 6 weeks after the end of each financial year which will be 30 May of each year. The Secretary/Treasurer will present the balance on the bank account at the end of each month to the committee no later than the 15th day of the following month. The committee, at its discretion, may publish the balance sheet as at the end of each accounting period on the website.
